You can't say, you have a right to free speech, but you are going to jail despite that right. A right is a restriction on government to respond in any negative way in response to your actions within that domain. And those restrictions are not dependent on who the government would be acting on, because the Bill of Rights is a list of things the government wholesale can't do.
